These Conditions of Purchase govern the use of the website www.e-lija.com, which is owned by Dinamic Abrasivos S.L.

DINAMIC ABRASIVOS, S.L., trading under the name e-lija, which shall be the name used hereinafter, is a Spanish company with premises located at calle Partida dels Cahuets, w/o no. 46470-Albal, Valencia, with corporate tax ID number B-46.691705, and telephone number: +34.961.272.521.

Registered in the Mercantile Registry of Valencia, at Volume 2759, General 76 of the General Companies Section, Folio 95, Sheet No. V-1155, Entry 10

Users who purchase items on  www.e-lija.com (hereinafter, the Website) fully accepts these Conditions of Purchase and shall be bound by them, as if they were drafted at the moment of purchase, in accordance with the terms provided in the relevant Spanish regulations.

e-lija reserves the right to change the Conditions of Purchase at any time without notice. The Conditions of Purchase shall be accessible at all times on the Website so that the user can view them or print them at any time.

These Conditions lay down the rights and obligations of all e-lija users in relation to the products and services that are offered via the Website.

The User takes responsibility to use the Website correctly. This responsibility shall cover:

• Using the Website solely and exclusively to make consultations and purchases or acquisitions that are legally valid.
• Refraining from making any false or fraudulent purchase. If it can be reasonably considered that any such purchase has been made, it may be cancelled, and the relevant authorities will be informed.
• Providing true and legitimate contact details, including but not limited to: email address, company name and/other information (see Legal Notice and Privacy Policy).

The prices quoted on the Website are expressed in euros (€), as are the current applicable taxes. Therefore, they are final prices and will only be increased in the purchase process on account of taxes and transportation expenses that apply according to the destination and are specified in section 6 - Deliveries and Delivery Times.

These prices and conditions of sale are for information purposes only and may be changed in view of market fluctuations, which will be displayed when the User registers on the Website Notwithstanding, the placing of an order by filling in the purchase form, which the User has selected and chosen willingly and freely, entails agreement with the price quoted and the general conditions of sale, in effect at that precise moment. Once the order has been placed, the purchase shall be deemed to have been placed by law, with all the legal guarantees that protect the acquiring consumer and, from that moment, the prices and conditions shall be contractually binding and may not be modified without the express agreement of both parties thereto.

The methods of payment accepted by e-lija are: Credit cards, bank transfer in advance or Bizum.

e-lija uses all means to ensure the confidentiality and security of the payment details provided by the User during the transactions via the Website. As such, the Website uses a secure payment system SSL (Secure Socket Layer).

Credit cards undergo checks and authorisations by the issuing banking institution thereof. If said institution does not authorise the payment, e-lija shall not bear any responsibility for any delay or failure to deliver and will be unable to formalise any contract with the User.

The card will be charged at the moment that the confirmation of the shipment is sent to the User.

On selecting advance bank transfer as a method of payment, you will receive an email together with your order confirmation which will tell you the account number to make the bank transfer for the account of e-lija - DINAMIC ABRASIVOS, S.L.

Please quote the following in the subject line: Your full name and Order Number.

The transfer must be made within the 72 hours following the order confirmation date so that we can validate it.

The order shall be deemed effective when we receive the proof of the transfer or the bank's confirmation thereof.

Payments are only accepted in EUROS. All exchange commissions and/or bank charges are borne by the purchaser. In the case of bank transfers made from outside Spain, it is important that, when mandating the transfer, you tell your bank not to charge e-lija the commissions and expenses at source charged by your bank.Otherwise, e-lija may suspend shipping your order since we will not have received the full amount of payment.

By clicking on “complete purchase", the User confirms that the method of payment used is the one they have selected.

e-lija will make all possible endeavours to meet its customers’ requests. However, all orders are subject to the availability of the products and, in this regard, if difficulties should arise in terms of their supply, or a possible stock-out, e-lija will provide the user with information about replacement products.

If you do not wish to place an order for those replacement products, e-lija will refund you the amount you may have paid.

The mere fact of placing an order on the Website entails the full and complete acceptance of the prices, the description of the products for sale and the Purchase Conditions, which shall be the only ones applicable to the contract.

The User undertakes to provide e-lija with the email address and all contact details and is aware that we may use this information to contact you if it should prove necessary.

If the User selects credit card as a method of payment when placing an order on the Website, the User warrants that he or she is fully authorised to use it. Only persons with the requisite legal capacity to enter into contracts, in relation to the type of goods and services offered on this website, may place orders.

To place an order, you must follow the online purchase procedure up to and including payment. When this is complete, you will receive an email acknowledging receipt of your order. This will not mean that your order has been accepted, rather, it constitutes an offer that the User makes to e-lija to purchase one or more products. All orders are subject to our acceptance and we will confirm such acceptance to you by sending you an email in which we will confirm that the product(s) are being shipped. The contract for the purchase of our products shall be formally executed only when we send you the Shipping Confirmation.

Only the product(s) listed in the Shipping Confirmation shall be covered by the Contract of Sale. We are under no obligation to supply you any other product that may have been included in the order until we confirm to you that they have been shipped.

Shipments will be made to whole of Spain (Peninsula, Balearic Islands and Canary Islands). e-lija may also carry out international shipments upon request.

e-lija will charge a flat fee of €10 for transportation for all shipments made in the peninsula; for shipments to the Balearic Islands, it will charge €15; for shipments to other geographical regions please ask us the amount beforehand via the email address:  abrasivos@e-lija.com. Delivery will be free of charge for orders over €190 in peninsular Spain or €300 in the Balearic Islands.

DINAMIC ABRASIVOS S.L. undertakes to ship its customers’ orders within a time frame of between 24 and 48 hours of its products in stock. For products manufactured to order we offer shipment within 48 hours. It is clearly understood that this time frame refers to the time that elapses between our receiving the order and the dispatch thereof, provided such orders are received before 18:00 CET (19:00 in the Canary Islands).

Notwithstanding the foregoing, this time frame excludes Saturdays, Sundays and public holidays, both national and in autonomous communities.

These time frames are estimated. Hence, they may vary for logistical reasons or due to force majeure.

If for any reason we are unable to fulfil the estimated delivery date, e-lija will inform you of this circumstance and give you the option to go ahead with the purchase, establishing a new delivery date.

An order is deemed to have been delivered when the customer has signed the delivery receipt. Once delivery has been received, the purchaser will have 72 hours to check that the order is undamaged and complete and inspect it to ensure that it matches the item(s) ordered. Once this period of time has elapsed, the shipment will be deemed accepted and no complaints for damages or faults in the order will be accepted.

However, if the User receives a product that has been damaged in transit, we recommend contacting e-lija within the first 24 hours via the email address abrasivos@e-lija.com to be able to report the issue to the haulier/courier. Likewise, whenever possible, we recommend that you instruct the courier or haulier to log the incident.

Apart from the above, e-lija has a delivery service to clients of the contracting party called “e-lija direct”; this service shall be subject to the same terms and conditions as those specified above. These shipments will be entirely anonymous and confidential in their packaging and documentation (see Privacy Policy and Legal Notice). e-lija will inform the contracting party when they leave its premises so that the purchaser will know the delivery times.

In cases in which the User acquires products through the owner's Website, the User has a series of rights, as set out in the General Act for the Protection of Consumers and Users (the TRLGDCU, in its initials in Spanish), which are described below:

The User is making a purchase on the Website and therefore has the right to withdraw from said purchase in a period of 14 calendar days, without any need for explanation, provided the products have not been manufactured expressly for the customer.

This cooling-off period will expire when 14 calendar days have elapsed from the date when the User acquired possession of the goods on e-lija's website.

To exercise this right of withdrawal, the User must give notice of its decision to e-lija. Users may do so, where applicable, via the “CONTACT” section of the Website, by filling in the form on the Website, or by the following means:

As stated in article 103 of the said law, the right to withdraw shall NOT apply to contracts that involve:

• Customised/personalised products that have been manufactured in accordance with the consumer's exact instructions, provided there is no manufacturing defect.
• Products that have been altered after purchase.

The User, regardless of the medium they choose to communicate their decision, must express clearly and unmistakeably that it is their intention to withdraw from the purchase contract.

e-lija will reimburse the User, using the same method of payment the latter used to carry out the original purchase transaction. This reimbursement will not generate any additional cost for the User. Nevertheless, e-lija may withhold said amount until it has received the purchased products.

The User shall bear the direct cost of the return (shipping, delivery) of the goods. Furthermore, the User shall be liable for any reduction in the value of the products resulting from handling thereof.

The photographs and reproduced texts featured in respect of the products offered for sale are for information purposes only.

E-lija's liability in relation to any product acquired on the Website shall be strictly limited to the purchase price of said product and shall not be compromised by any simple errors or omissions that may have occurred, when all necessary precautions have been taken in the presentation of the products.

e-lija cannot be held liable for any harm or loss, of whatever kind, be it tangible or intangible, or for physical injury, that may result from any inappropriate operation or use of the products sold. This also applies to any alterations made to the products by users.

DINAMIC ABRASIVOS S.L shall not be held liable for any non-fulfilment of a signed contract in the event of a product being out of stock or unavailable, due to force majeure.

The provisions set out in this Clause shall not affect the consumer rights recognised by law, nor their right to withdraw from the contract.

In the event of dispute, the customer may contact, in the first instance, DINAMICABRASIVOS S.L, to arrive at an amicable resolution.

DINAMIC ABRASIVOS S.L. on its own behalf or as an assignee, is the owner or legitimate holder of all the intellectual and industrial property rights of the Website, as well as of the elements contained therein (by way of example and without limitation: images, sound, audio, video, software or texts; brands or logos, colour combinations, structure and design, selection of materials used, computer programs necessary for its operation, access and use, etc.), owned by DINAMIC ABRASIVOS S.L.

All rights reserved. On the basis of the provisions of articles 8 and 32.1, paragraph two, of the [Spanish] Intellectual Property Act, the reproduction, distribution and public communication, including any method to make them available, of all or part of the content of this website, for commercial purposes, in any medium and by any technical means, without the authorisation of DINAMIC ABRASIVOS SL, is expressly prohibited.

The user undertakes to respect the Intellectual and industrial property rights held by DINAMIC ABRASIVOS S.L. The user may view the elements of the portal and may also print them, copy them and store them on their computer's hard disk or in any other physical medium, provided that it is solely and exclusively for their own personal and private use. The user must refrain from removing, altering, evading or tampering with any protection device or security system that may be installed in e-lija's web sites.

These Conditions of Purchase are governed by Spanish law.

The Parties voluntarily submit, for the resolution of conflicts, to the courts and tribunals of Valencia (Spain) and waive recourse to any other forum.
